1. ACCEPTANCE OF TERMS

By accessing or using Grow Sense and any services provided by The Photon Lab ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms apply to all users of Grow Sense, including beta testers, registered users, and visitors to thephotonlab.io.

2. DESCRIPTION OF SERVICE

Grow Sense is a cannabis cultivation management platform that provides tools including AI-assisted diagnostics, environment tracking, nutrient calculators, grow journaling, and educational resources. The service is currently in beta. Features may change, be added, or be removed at any time without notice.

3. EDUCATIONAL PURPOSE & DISCLAIMER

IMPORTANT: All information, recommendations, AI responses, and tools provided by Grow Sense are for EDUCATIONAL PURPOSES ONLY. The Photon Lab is not responsible for the outcomes of any cultivation decisions made based on information provided through our platform. AI-generated advice is a starting point only — always verify recommendations before making significant changes to your grow operation. We make no guarantees regarding crop yield, quality, potency, or any other outcome. Growing results depend on countless factors outside our control.

4. LEGAL USE ONLY

You agree to use Grow Sense only for legal cultivation activities in your jurisdiction. You are solely responsible for understanding and complying with all applicable local, state, and federal laws regarding cannabis cultivation in your area. The Photon Lab does not encourage, facilitate, or support illegal activity of any kind. By using our service, you represent that your cultivation activities are legal where you are located. We reserve the right to terminate accounts that we reasonably believe are being used for illegal purposes.

5. BETA ACCESS & INVITE CODES

Grow Sense is currently in invite-only beta. Access requires a valid invite code issued by The Photon Lab. Invite codes are non-transferable and are issued for personal use only. We reserve the right to revoke beta access at any time. Beta users may experience bugs, downtime, data loss, or feature changes. By participating in beta, you acknowledge these risks.

6. USER ACCOUNTS

You are responsible for maintaining the security of your account credentials. Do not share your password with others. You are responsible for all activity that occurs under your account. Notify us immediately at contact@thephotonlab.io if you suspect unauthorized access to your account. We reserve the right to terminate accounts for any violation of these terms.

7. AI-GENERATED CONTENT

Grow Sense uses artificial intelligence (Anthropic Claude) to generate responses to user queries and analyze photos. AI responses are generated automatically and have not been reviewed by a human expert before delivery. AI responses may be inaccurate, incomplete, or outdated. Never act on AI advice alone for decisions that could significantly impact your grow, health, or safety. Always cross-reference with established growing resources and professionals. You acknowledge that AI technology has limitations and that The Photon Lab is not liable for any damages arising from reliance on AI-generated content.

8. PHOTO UPLOADS & USER CONTENT

When you upload photos or submit content to Grow Sense, you grant The Photon Lab a non-exclusive license to process that content for the purpose of providing our service (AI analysis, diagnostics, etc.). We do not sell your photos or grow data to third parties. We do not use your photos for AI training without explicit consent. You retain ownership of all content you upload. You represent that you have the right to upload any content you submit and that it does not violate any third-party rights.

9. PRIVACY POLICY

DATA WE COLLECT: - Email address (for account creation and communication) - Grow data you enter (journal entries, parameters, harvest data) - Photos you upload for diagnostics - Usage data (pages visited, features used) for improving the service HOW WE USE YOUR DATA: - To provide and improve Grow Sense - To send important account and service updates - To analyze aggregate usage patterns (anonymized) WE DO NOT: - Sell your personal data to third parties - Share your individual grow data with advertisers - Use your data for purposes beyond operating and improving Grow Sense DATA RETENTION: Your data is retained as long as your account is active. You may request deletion of your account and associated data at any time by contacting contact@thephotonlab.io. THIRD-PARTY SERVICES: We use Supabase for database and authentication, Anthropic for AI capabilities, and Vercel for hosting. These services have their own privacy policies and data handling practices.

10. COOKIES & TRACKING

Grow Sense uses essential cookies for authentication and session management. We do not use third-party tracking cookies or advertising cookies. We may use anonymized analytics to understand how users interact with our platform and improve the service.

11. INTELLECTUAL PROPERTY

All content, design, code, branding, and materials on Grow Sense and thephotonlab.io are the property of The Photon Lab and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our platform without express written permission. "The Photon Lab," "Grow Sense," and "Where Spectrums Collide" are trademarks of The Photon Lab.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PHOTON LAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF GROW SENSE. THIS INCLUDES BUT IS NOT LIMITED TO: crop loss, financial loss, equipment damage, or any other damages arising from following advice generated by our platform. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. CHANGES TO TERMS

We may update these Terms of Service at any time. We will notify registered users of significant changes via email or in-app notification. Continued use of the service after changes constitutes acceptance of the updated terms.
